1. Agreement to Terms

By accessing and using MapMyProject (the "Application," "Service," or "Platform"), whether through our mobile application (Android/iOS) or web interface, you accept and agree to be bound by the terms and provisions of this agreement ("Terms of Use"). If you do not agree to abide by these Terms of Use, please do not access or use this Application.

These Terms of Use constitute a legally binding agreement between you ("User," "you," or "your") and Saffron Consulting Engineers ("Company," "we," "us," or "our") concerning your access to and use of MapMyProject.

2. Description of Service

2.1 Overview

MapMyProject is a construction project monitoring and management platform that enables users to:

• • Record Daily Progress Reports (DPRs)
• • Track zones, drawings, and project layouts
• • Manage labor, materials, and machinery
• • Report and track issues with photo uploads
• • Schedule activities and monitor milestones
• • Collaborate with team members within companies
• • Generate reports and analytics

2.2 Platform Access

The Service is accessible through:

• • Mobile Application: Android app available on Google Play Store
• • Web Platform: Browser-based access via our web application
• • API Integration: Programmatic access (for authorized enterprise users)

3. Account Registration and Use

3.1 Account Creation

To use MapMyProject, you must:

• • Be at least 18 years of age
• • Provide accurate, current, and complete information during registration
• • Maintain and promptly update your account information
• • Be authorized to represent your company (if registering on behalf of an organization)

3.2 Account Security

You are responsible for:

• • Maintaining the confidentiality of your account credentials
• • All activities that occur under your account
• • Notifying us immediately of any unauthorized use or security breach
• • Using a strong password and changing it periodically

3.3 Company Accounts

MapMyProject operates on a company-based multi-tenancy model. When you create or join a company:

• • You confirm you have authority to represent the company
• • Your data is isolated and accessible only to company members
• • Company administrators can manage user roles and permissions
• • Company administrators can remove users from the company

4. Acceptable Use Policy

4.1 Permitted Use

You may use MapMyProject for lawful purposes related to:

• • Construction project management and monitoring
• • Recording and tracking project progress
• • Team collaboration and communication
• • Resource (labor, materials, machinery) management
• • Generating project reports and analytics

4.2 Prohibited Activities

You agree NOT to:

• • Violate any applicable local, state, national, or international law
• • Infringe upon or violate intellectual property rights of others
• • Upload or transmit viruses, malware, or any harmful code
• • Attempt to gain unauthorized access to the system or other user accounts
• • Interfere with or disrupt the Service or servers
• • Use automated means (bots, scrapers) to access the Service
• • Reverse engineer, decompile, or disassemble the Application
• • Resell or redistribute the Service without authorization
• • Upload obscene, defamatory, or illegal content
• • Impersonate any person or entity
• • Share your account with unauthorized users

5. User Content and Data

5.1 Ownership of User Content

You retain all ownership rights to content you upload to MapMyProject, including:

• • Daily Progress Reports (DPRs)
• • Photos and images
• • Project drawings and documents
• • Labor, material, and machinery records
• • Issue reports and descriptions
• • Any other data you create or upload

5.2 License to Company

By uploading content, you grant Saffron Consulting Engineers a non-exclusive, worldwide, royalty-free license to:

• • Store, process, and display your content within the Application
• • Provide the Service to you and your company members
• • Perform backups and ensure data redundancy
• • Analyze aggregated, anonymized data for service improvement

We will NOT sell, share, or use your project-specific content for any purpose other than providing the Service.

5.3 Content Responsibility

You are solely responsible for:

• • The accuracy and completeness of data you enter
• • Ensuring you have rights to upload photos and documents
• • Complying with privacy laws when uploading photos of individuals
• • Ensuring uploaded content does not violate any laws or third-party rights

6. Data Loss and Backup Disclaimer

6.1 No Guarantee Against Data Loss

Data loss may occur due to (but not limited to):

• • Server hardware failures or malfunctions
• • Natural disasters, fires, floods, earthquakes
• • Cyberattacks, hacking, ransomware, or security breaches
• • Software bugs or database corruption
• • Human error during maintenance or upgrades
• • Interruption of third-party services (cloud hosting, databases)
• • Force majeure events beyond our reasonable control
• • Account deletion or termination

6.2 User Responsibility

You are solely responsible for maintaining your own backup copies of critical project data. We strongly recommend:

• • Regularly exporting important project records
• • Maintaining offline copies of critical documents and drawings
• • Keeping original photos and files on your devices
• • Not relying solely on MapMyProject as your only data repository

6.3 Backup Procedures (Informational Only)

While we maintain backups, you acknowledge that:

• • Backups may not capture real-time data
• • Backup restoration may not be complete or instantaneous
• • Some recent data may be lost even with backups
• • Backup procedures may change without notice

7. Service Availability and Uptime

7.1 No Uptime Guarantee

We strive to provide reliable service, but we do NOT guarantee:

• • Uninterrupted or error-free operation
• • Any specific uptime percentage
• • That the Service will meet your specific requirements
• • That defects will be corrected immediately

7.2 Planned and Unplanned Downtime

The Service may be unavailable due to:

• • Scheduled maintenance and updates
• • Emergency maintenance
• • Server issues or hosting provider problems
• • Internet connectivity issues
• • Third-party service disruptions

We will make reasonable efforts to notify users of scheduled maintenance in advance.

8. Accuracy of Information

8.1 No Professional Engineering Advice

8.2 User Data Accuracy

We are NOT responsible for:

• • Accuracy, completeness, or validity of data entered by users
• • Verification of measurements, quantities, or calculations
• • Errors in user-generated reports or analytics
• • Decisions made based on data within the Application

8.3 Third-Party Integrations

MapMyProject may integrate with third-party services (MapBox Maps, Firebase, Analytics). We are not responsible for the accuracy or reliability of these external services.

9. Intellectual Property Rights

9.1 Ownership of Application

MapMyProject, including all software, code, designs, graphics, interfaces, and documentation, is owned by Saffron Consulting Engineers and is protected by Indian and international copyright, trademark, and intellectual property laws.

9.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use MapMyProject solely for your internal business purposes. This license does NOT permit:

• • Redistribution, resale, or sublicensing of the Service
• • Creation of derivative works
• • Reverse engineering or decompiling the software
• • Removing copyright or proprietary notices
• • Using the Service to build competing products

9.3 Trademarks

"MapMyProject," "Saffron Consulting Engineers," and related logos are trademarks of Saffron Consulting Engineers. You may not use these marks without our prior written permission.

10. Privacy and Data Protection

Your use of MapMyProject is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data collection, use, and protection practices.

11. Subscription Plans and Payments

11.1 Subscription Plans

MapMyProject offers paid subscription plans with varying features and usage limits by plan tier. A trial period may be available to evaluate the platform before purchasing a subscription.

11.2 Billing

For paid subscriptions:

• • Billing is recurring (monthly or annually) unless cancelled
• Payment must be made in advance via bank transfer
• Prices are subject to change with 30 days' notice
• Payment instructions will be provided upon subscription activation

11.3 Refunds

All subscription fees are non-refundable. Payments made for MapMyProject subscriptions cannot be refunded under any circumstances. Please evaluate the platform using the trial period before committing to a paid subscription. For any questions, contact us at mapmyproject@saffronconsulting.net.

11.4 Suspension for Non-Payment

We reserve the right to suspend or terminate accounts with overdue payments after reasonable notice. Data will be retained for 60 days after payment failure, after which it may be permanently deleted. We strongly recommend ensuring timely payment to avoid data loss.

12. Limitation of Liability

12.1 No Consequential Damages

IN NO EVENT SHALL SAFFRON CONSULTING ENGINEERS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• • Loss of profits, revenue, or business
• • Loss of data or information
• • Loss of goodwill or reputation
• • Cost of substitute services
• • Project delays or construction defects
• • Any other intangible losses

This applies WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, even if we have been advised of the possibility of such damages.

12.2 Cap on Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO MAPMYPROJECT SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

12.3 Basis of the Bargain

You acknowledge that these limitations of liability are an essential basis of our agreement and that we would not provide the Service without these limitations.

13. Indemnification

You agree to indemnify, defend, and hold harmless Saffron Consulting Engineers and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• • Your use or misuse of the Service
• • Your violation of any law or regulation
• • Your violation of any third-party rights
• • Content you upload or actions you take within the Application
• • Any construction project decisions made based on Application data

14. Termination

14.1 Termination by User

You may terminate your account at any time by:

• • Using account deletion features within the Application (if available)

14.2 Termination by Company

We may suspend or terminate your access immediately, without prior notice or liability, for any reason, including:

• • Breach of these Terms of Use
• • Illegal or fraudulent activity
• • Non-payment of fees
• • Abuse of the Service or other users
• • Extended account inactivity

14.3 Effect of Termination

Upon termination:

• • Your right to use the Service ceases immediately
• • We may delete your account and data after a reasonable grace period
• • No refunds will be provided for unused subscription time (unless required by law)
• • All provisions of these Terms that should survive will continue (IP rights, limitations of liability, indemnification)

15. Modifications to Terms

15.1 Right to Modify

We reserve the right to modify or replace these Terms of Use at any time at our sole discretion. Changes will be effective:

• • Immediately for minor clarifications or bug fixes
• • After 30 days' notice for material changes

15.2 Notification of Changes

We will notify users of material changes via:

15.3 Acceptance of Changes

By continuing to access or use MapMyProject after changes become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

16. Governing Law and Jurisdiction

16.1 Indian Law

These Terms of Use shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Specifically, these Terms are subject to:

• • Other applicable Indian laws and regulations

16.2 Jurisdiction

Any disputes arising out of or relating to these Terms or MapMyProject shall be subject to the exclusive jurisdiction of the courts located in Bengaluru (Bangalore), Karnataka, India.

16.3 Dispute Resolution

Before filing any formal legal action, you agree to:

• • Attempt to resolve disputes informally and in good faith
• • Allow us 30 days to respond and attempt resolution

If informal resolution fails, disputes may proceed to arbitration or court proceedings in Bengaluru, Karnataka, India.

17. Severability

If any provision of these Terms of Use is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

18. Entire Agreement

These Terms of Use, together with our Privacy Policy and any other legal notices or agreements published by us within MapMyProject, constitute the entire agreement between you and Saffron Consulting Engineers concerning your use of the Application. These Terms supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.

19. Waiver

No waiver by Saffron Consulting Engineers of any term or condition in these Terms shall be deemed a continuing waiver of such term or condition or a waiver of any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

20. Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms or any rights hereunder without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties and their successors and permitted assigns.

21. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

22. Export Control

MapMyProject may be subject to Indian export control laws and regulations. You agree to comply with all applicable export and re-export control laws and regulations in your use of the Service.

23. Third-Party Rights

These Terms do not confer any third-party beneficiary rights. No provision of these Terms shall be deemed to create any agency, partnership, joint venture, employer-employee, or franchisor-franchisee relationship between you and Saffron Consulting Engineers.
